Acceptable Use Policy
Last updated: [DATE]. Effective: [DATE].
This policy explains what you can and cannot make with Madwackd Studio™. It is part of our Terms of Service. Our video models run on Google Cloud Vertex AI, so you must also follow Google's Generative AI Prohibited Use Policy, which we pass through to you here. If this policy and Google's policy differ, the stricter rule applies.
1. Never allowed
Do not use the Service to create, upload, request or share:
- Any sexual or sexualized content involving minors, or content that exploits or endangers children in any way. We report child sexual abuse material to the National Center for Missing & Exploited Children and law enforcement.
- Nonconsensual intimate imagery, real or AI-generated, including "deepfake" nudes or sexual content of any real person.
- Sexually explicit content, pornography or content made for sexual gratification.
- Content that promotes, supports or helps violent extremism or terrorism.
- Content that encourages or gives instructions for self-harm or suicide.
- Hate speech, harassment, bullying, threats or intimidation of any person or group.
- Graphic violence meant to shock, or content that incites violence.
- Content that helps anyone make or get weapons, illegal drugs or other regulated goods, or that otherwise helps illegal activity.
2. Real people, likeness and voice
A person's face, body, name and voice belong to them. Before you use any real, identifiable person in a prompt, image, video or voice sample, you must have their consent.
- Written consent is required for any real person whose likeness or voice you upload or recreate, including yourself if you are uploading on behalf of a business. Consent must cover the specific use (for example, "a 30-second ad for my company on social media").
- Voice cloning: you may only create a custom or cloned voice from recordings of your own voice, or of a person who has given you written permission to clone their voice for your stated use. You may be asked to confirm consent before a voice is created, and we may ask to see it.
- Deceased people: using the likeness or voice of a deceased person may require permission from their estate. Do not use it without that permission.
- Public figures and celebrities: do not create content that makes it look like a public figure said, did or endorsed something they did not, unless it is clearly labeled parody or commentary, it is lawful where you publish it, and it does not deceive anyone.
- Impersonation: do not impersonate any real person, living or dead, to deceive anyone.
- Some states (such as Tennessee's ELVIS Act, and California and New York digital replica laws) give extra protection to voice and likeness. You are responsible for following the laws where you publish.
3. Deception and fraud
- No scams, fraud, phishing or impersonation of businesses, government agencies or officials.
- No fake reviews or testimonials. Do not create videos of AI "customers" or "experts" and present them as real people sharing real experiences. The FTC's 2024 rule on consumer reviews and testimonials bans this and carries civil penalties.
- No false claims of expertise in health, finance, law or government services.
- No election misinformation, including false information about when, where or how to vote, and no undisclosed deepfakes of candidates. Colorado and other states require disclosure on AI-generated content about candidates near elections.
- No passing off AI-generated content as entirely human-made in order to deceive.
- No AI-voiced robocalls without the consent the law requires.
4. Rights of others
- Do not upload or recreate copyrighted material, trademarks or logos you do not have rights to use.
- Do not violate anyone's privacy, including by covertly tracking people or exposing private information.
5. Security and safety filters
- Do not try to bypass, trick or disable our or Google's safety filters, including through "jailbreak" prompts or by splitting a blocked request into parts.
- Do not remove, alter or defeat SynthID watermarks, content credentials or other provenance signals in your Outputs.
- Do not use the Service for spam or malware, or to disrupt our service or anyone else's.
- Do not scrape the Service, resell access, or use it or its Outputs to build or train a competing AI model.
- Do not use the Service to make high-stakes automated decisions about people (such as hiring, housing, lending, insurance or health care) without meaningful human review.
6. Limited exceptions
Some content that touches these topics may be allowed for genuine educational, documentary, news, scientific or artistic purposes, where the benefit clearly outweighs the risk of harm. Our safety filters may still block it, and the final call is ours and our providers'. Nothing in this section ever permits content involving minors in sexual situations or nonconsensual intimate imagery.
7. Enforcement
We and our providers use automated filters and may review flagged content. If you break this policy, we may block renders, remove content, suspend or close your account, keep unused credits where the law allows, and report illegal content to authorities.
8. Report content or ask for removal
Anyone can report content, with or without an account.
Nonconsensual intimate images (TAKE IT DOWN Act)
If you believe the Service holds an intimate image or video of you, real or AI-generated, that was published without your consent, you or someone authorized to act for you can ask us to remove it. Use the contact form on our website and choose "Intimate image removal." Your request must include:
- Your physical or electronic signature (typing your full name counts), or that of the person acting for you.
- Enough information for us to find the content, such as a link, project name or description.
- A short statement that you believe in good faith the image was published without your consent.
- Contact information for you or the person acting for you.
We will remove the content, and make reasonable efforts to find and remove identical copies on the Service, within 48 hours of receiving a valid request.
Other likeness, voice or harmful content reports
To report an unauthorized use of your likeness or voice, or any other content that breaks this policy, use the contact form and choose "Report content." Tell us who you are, what the content is and where to find it. We review reports promptly and act where appropriate.
